Lost Hood

We used this company prior to this time and was highly pleased, so we did not hesitate to use them again. BIG MISTAKE!!! Shortly after our car was picked up in California, the sellers called us to let us know that the hood had flown off of the car. Long story short...the driver told them not to tell us and he never stopped to even try to recover the hood. (I don't think he was insured and did not want to be on the police report.) We got a whole different story from the driver when he delivered the car from the sellers...bottom line their is a police report in California as a result of our hood flying off and causing a wreck that the driver didn't care to see if anyone was hurt with or be responsible for. We called the transport company thinking that they would be of any help and comfort but we thought wrong. I spoke to Lee in the claims department, he was sarcastic, rude, and a complete (word I choose not to say-let just say jerk) with an attitude. He basically could careless what happened and offered no reassurance that the rest of our car would come to us in one piece nor cared to find out what happened from the drivers point of view. I then called Mike hoping to get some reassurance and affirmation of what had happened. He did offer kind words and said that he would get to the bottom of it and call me back but I still haven't heard from him.

Bottomline - they are claiming that they are not liable. I have spoke to a local judge in my area and was informed otherwise. I am considering filing a civil suit against them and definitely reporting them to the BBB. Make sure that you don't care about your car if you use them because they say that they are not liable for ANY damages...the small print tries to give them a loop hole...but...we may just see if they are liable or not.

Express Auto Transport has honestly worked to inform customers by providing terms and conditions which are contractual in nature for both they, the consumer, and the persons with whom we contract. Damage caused by driver negligence is all a carriers cargo policy is responsible for. It may prove difficult for anyone to explain how the driver was negligent if a hood came loose while he was present behind the wheel of his truck. By definition a driver should be able to drive a car onto his trailer, properly secure the vehicle, transport it, and off load the car at the destination. The driver is not the only person involved in this process however, and other persons actions must also be taken into account. Items of liability are clearly outlined in our terms and conditions under article #2 which Express Auto Transport confirmed they received via email when their order was placed. Express Auto Transport took the additional time to outline this information in an email which was sent on 12/22/2008. Our terms are also accessible on our website, and are emailed to every online quote customers request.
