who should pay for my damaged windshield?

I had very bad experience with Complete Auto Sales. The delivery was late and hard to reach anyone during the expected delivery dates. The worst part wss my brand new vehicle windshields was cracked and the frame paint was chipped. I was told to get estimate of the fixes. Tow days later I was told they are not liable for any damages. Here's the response I got from Complete Auto Sales in multiple emails.

"Contact your Insurance Company. They will tell you this is called hazard of the road. We are not liable."

"We have a $10,000 deductible. Your insurance can attempt to subrogate against us."

"AA Automovers is in no way involved in this matter. I have explained that contacting our insurance will be a waste of your time. If I were in your shoes I would do what I have already told you to do. File a claim with your insurance Co. They will repair your car and attempt to subrogate against us..."

They also said the damaged is unlikely caused by them even I had their truck driver documented and took pictures of the damages at the time of the deliveries.

Can anyone advice me how to deal with this case? Contact my insurance will be my last option. I want to do the right way.
