To be honest, most of what Mr. Moselina had to say was not far from the truth. However, when he placed the order the following was part of the contract:
Try to give us at least a 3 day window to pick up your vehicle. (This means that your vehicle should be available for a 3 day time period.) It doesn’t mean that you have to stay home for 3 days. THIS WINDOW IS NOT GUARANTEED. Please have an alternate person to release you vehicle should there be a delay.
It also said the following:
The deposit (broker fee) for your transport is fully refundable until your vehicle has been scheduled on a Carrier. Cancellation of order must be in writing by e-mail or fax.
When he placed the order the following email was sent to him. It read as follows:
We understand that your 2009 Toyota Prius will be available for pickup on or after 4/30/2010. Be sure to have an alternate pick up contact should we be unable to meet your pick up window.
Mr. Moselina never cancelled the order by e-mail or fax. Mr Moselina didn't have an alternate person to release his vehicle. If he had cancelled before the scheduling he would have been refunded. Mr. Moselina thinks he can make his own rules. Unfortunately all carriers run into delays at times. That is why our window is not guaranteed. A 2 or 3 day delay is not uncommon in the transport business.
Finally, Mr.Moselina was never told by me that he was on his own. That is an outright lie! His car would have been picked up on 5/5 or 5/6 if he had not gone with another carrier. That is a 2-3 day delay.
